REENACTMENTS – TERMS OF USE

Reenactment materials:

The Second Circuit Judicial Council Committee on Civic Education & Public Engagement (the “Committee”) has gathered and/or created certain materials (“Reenactment materials”) for use in connection with reenactments of historical trials (“Reenactments”), in support of its mission to increase public understanding of the courts.

The Committee is providing the Reenactment materials to the public for use for non-commercial educational purposes, as described in more detail below. As a condition of your accepting and/or using the Reenactment materials, you agree to abide by all of the terms and conditions set forth in these Terms of Use.

The term “you,” as used in these Terms of Use, means the person submitting the request to access the Reenactment materials and, if that person is acting on behalf of an organization, the organization. By submitting a request for use by an organization, the requestor represents that he or she is authorized to act on behalf of the organization and that the organization will be bound to comply with these Terms of Use.

Permitted Uses; Conditions of Use

You agree to use the text, images, audio, video, designs and other material made available by the Committee (“Content”) only in non-commercial, nonprofit, educational live (non-recorded) presentations of the Reenactment(s) requested by you in the request for Reenactment materials, and only on the date(s) of performance of the Reenactment(s) provided by you in that request (the “permitted use”), and for no other purpose. Without limitation of the foregoing, you shall not sell or license or otherwise make available any of the Content to any third party or charge any fee for admission to any Reenactment in which any of the Content is used.

When using the Content, you agree to provide credit to the author or creator of the Content, if such name(s) is provided to you by the Committee.

You shall not remove from any of the Content any copyright, trademark, or other proprietary notice, including any attribution information, credits, and notices.

You shall ensure that any persons to whom such Content is distributed are informed of and comply with the terms and conditions set forth in these Terms of Use.

Intellectual Property Rights; Permissions and Clearances

The Content may be the property of the Committee, or may be the property of others and made available for use with their permission (such as content provided with permission from various bar associations and other legal organizations), or may be historical material as to which ownership has not been determined and/or permission to use has not been obtained by the Committee, or may be in the public domain. Accordingly, some of the Content may be subject to intellectual property and other laws (such as laws relating to copyright, trademark, rights of publicity and privacy or moral rights) and/or contractual restrictions.

In the Committee’s discretion, the Committee may provide information that it possesses about the Content and identify restrictions that may apply to use of the Content. However, you recognize and understand that the Committee can offer no guarantee or assurance that all pertinent information is provided or that the information is correct in each circumstance or that a use of any of the Reenactment materials does not require permission from a third party or violate the rights of a third party. You must determine for yourself whether or not an item of Content is protected by copyright or in the public domain, and then satisfy any copyright or other use restrictions when using the Content. Reproduction or public performance of copyrighted material beyond what is allowed by fair use or other exemptions requires written permission from the copyright holder. You agree not to use any of the Content in a manner that infringes or violates any intellectual property, proprietary, contractual or legal right of any person or entity.

Disclaimer; No Warranties

The Content is provided “as is” without any warranty of any kind, either express or implied. The Committee expressly disclaims all warranties of any kind, express or implied, including any warranties of fitness for a particular use and/or non-infringement. Neither the Committee nor the Second Circuit shall be responsible or liable for your use of the Reenactment materials or downloading any Content from the Reenactment materials site, including, without limitation, with respect to any liability to any third party with respect to material owned by the third party.

Applicable Law and Jurisdiction

These Terms of Use and any amendments or revisions are governed by applicable federal law and the laws of the State of New York, without regard to its conflict of laws principles.

Use of Information

By submitting a request for Reenactment materials, you agree that the Committee may collect, use and disclose information that you provide in your application and in the course of your permitted use of the Content, including, without limitation, the dates of performance of the Reenactment and the name or other details of the organization conducting such Reenactment.
